Terms and Conditions
& Licensing Agreement
These terms govern access to and use of Goldscale, a free educational browser game provided by Elevate Inc.
Contents
1. Acceptance of these terms
By accessing, opening, or playing Goldscale, you agree to these Terms and Conditions and Licensing Agreement. The words “Goldscale,” “game,” “service,” “we,” “us,” and “our” refer to the Goldscale game and Elevate Inc. The words “you” and “player” refer to the person accessing or using the game and, when appropriate, that person’s parent or legal guardian.
If you do not agree to these terms, do not use Goldscale. Use of the game is also subject to the separate Parents, Privacy & Game Information page, which is incorporated into this agreement by reference.
2. Parents, guardians, and younger players
Goldscale is designed to make basic financial ideas understandable through play. A parent or guardian should review the game and these terms with a child. A parent or guardian who permits a child to use Goldscale accepts responsibility for supervising that use and helping the child understand that the game presents simplified, fictional examples.
Goldscale does not require a player to create an account or provide a name, email address, phone number, payment method, or precise location to play. Children should not submit private or sensitive information through the game or through an optional feedback message.
3. Educational purpose
Goldscale is offered for education and entertainment. It uses imaginary dragons, missions, gold, savings, investments, market stories, rewards, expenses, and purchases to encourage planning and thoughtful decision-making.
The game is not a bank, brokerage, financial institution, investment adviser, financial planner, legal service, tax service, credit counselor, or gambling service. Nothing in the game is a recommendation to buy, sell, save, borrow, invest, or enter any real transaction. Simulated results do not represent or predict actual market behavior or personal financial outcomes.
4. Limited license
Subject to this agreement, Elevate grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and play Goldscale for lawful, noncommercial education and entertainment.
This license does not transfer ownership of the game or any part of it. It ends automatically if you violate this agreement or if Goldscale is discontinued. Elevate may permit educators, parents, mentors, and community organizations to display the game for supervised educational use, provided they do not charge specifically for access to Goldscale or misrepresent their relationship with Elevate.
5. Restrictions and acceptable use
You may share the public Goldscale link and discuss the game. You may not:
- copy, sell, license, rent, publish, or commercially exploit the game or its source code;
- remove ownership notices or present Goldscale, Elevate branding, characters, artwork, or written material as your own;
- attempt to enter password-protected development, administration, server, or testing areas without authorization;
- interfere with gameplay, hosting, security, availability, or another person’s use;
- introduce malicious code, automated abuse, excessive requests, or unauthorized data collection;
- use the game, feedback feature, or Elevate identity for harassment, threats, fraud, impersonation, or unlawful conduct;
- use automated systems to scrape, reproduce, or create a competing copy of substantial parts of the game; or
- encourage another person to violate these restrictions.
6. Ownership and intellectual property
Goldscale and its original code, design, characters, names, artwork, sounds, animations, written material, educational structure, and branding are owned by or licensed to Elevate Inc. and are protected by applicable intellectual property laws. Elevate Inc., Goldscale, and related marks and presentation may not be used to imply sponsorship, approval, or affiliation without written permission.
Any rights not expressly granted in this agreement are reserved. Incidental browser caching and the temporary technical copies necessary to display the game are permitted as part of normal use.
7. Virtual items and gameplay
All gold, dragons, armor, firepower, savings, investments, vaults, rewards, scores, and other items inside Goldscale are fictional game elements. They have no cash value, cannot be purchased with real money, cannot be exchanged for money or property, and do not create a debt or financial obligation.
Elevate may rebalance prices, abilities, rewards, mission difficulty, simulated market movement, and other gameplay systems. No player has a property interest in a particular score, balance, dragon, upgrade, mission position, or version of a feature.
8. Saved progress
Goldscale currently saves public game progress in local browser storage on the player’s device. Progress may remain available when the same browser and website address are used, but it may be lost when browser data is cleared, private browsing is used, a different device or browser is used, storage is unavailable, or software changes occur.
Elevate will make reasonable efforts to preserve compatible progress during updates but does not guarantee permanent storage, recovery, transfer, synchronization, or restoration. Players should not rely on game progress as a record of real financial, educational, or personal activity.
9. Privacy and technical information
Goldscale does not require an account or direct identifying information to play. Normal web hosting may automatically generate technical access records needed to deliver and protect the website. Depending on server configuration, these records may include a request time, requested page, response status, browser information, device category, referring page, and internet protocol address.
Elevate may use limited first-party, aggregate statistics to understand visits, game starts, approximate session length, device categories, mission activity, technical errors, and general progress through the game. Such information is intended for operation, security, troubleshooting, and improvement, not advertising or behavioral profiling.
Elevate does not sell game-use information. Goldscale does not include targeted advertising or require payment information. Details about current practices appear on the Parents, Privacy & Game Information page. If data practices materially change, that page should be updated accordingly.
10. Suggestions and issue reports
The optional suggestion or issue feature opens the email provider configured on the user’s device. No message is sent until the user reviews and sends it through that provider. The provider’s own terms and privacy practices apply to that email.
A message may reveal the sender’s email address and anything the sender chooses to include. Children should obtain permission from a parent or guardian before sending feedback. Do not submit passwords, government identification numbers, financial account information, home addresses, medical information, or other sensitive material.
You permit Elevate to use nonconfidential ideas, corrections, and suggestions you voluntarily submit to evaluate or improve Goldscale without payment or an obligation to implement them. This permission does not transfer ownership of your personal information or unrelated original work.
11. Third-party services and links
Goldscale may contain links that open an email application, social media page, Elevate website, or another outside service. Elevate does not control the availability, content, security, or privacy practices of third-party services. A link is provided for convenience and does not necessarily mean Elevate endorses every statement, product, or practice on the destination service.
12. Updates and availability
Elevate may correct errors, add or remove features, revise artwork, change missions, rebalance gameplay, modify compatibility, perform maintenance, or discontinue some or all of Goldscale. Updates may occur without advance notice when necessary for security, reliability, or operation.
Elevate does not guarantee uninterrupted access, a particular release schedule, compatibility with every browser or device, or continued availability of any feature. Internet access, device compatibility, browser settings, and third-party outages may affect use.
13. Disclaimers
To the fullest extent allowed by law, Goldscale is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted operation, error-free operation, or permanent preservation of game progress.
Elevate does not guarantee that gameplay will produce a particular educational result or that simulated financial examples will match real-life outcomes. Parents, guardians, educators, and players remain responsible for real financial decisions and for determining whether the game is appropriate for their circumstances.
Nothing in this agreement excludes a warranty or right that applicable law does not permit to be excluded.
14. Limitation of liability
To the fullest extent allowed by law, Elevate and its directors, officers, employees, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from access to or use of Goldscale, inability to use it, loss of locally stored progress, device incompatibility, or reliance on simulated game information.
These limitations do not apply where applicable law prohibits them, and they do not limit responsibility that cannot legally be limited. Nothing in Goldscale replaces professional advice where such advice is appropriate.
15. Suspension or termination
Elevate may restrict or end access to Goldscale when reasonably necessary to protect the game, users, Elevate systems, or the public, or when a user violates these terms. A player may end this agreement at any time by stopping use of the game and, if desired, clearing the game’s locally stored browser data.
Sections concerning ownership, restrictions, disclaimers, liability, governing law, and other provisions that logically continue will survive termination.
16. Governing law
This agreement is governed by the laws of the Commonwealth of Kentucky and applicable federal law, without regard to conflict-of-law principles, except where consumer-protection law requires another result. Before filing a dispute, the parties are encouraged to attempt a reasonable, good-faith resolution by contacting Elevate.
17. General provisions
Entire agreement
These terms and the Parents, Privacy & Game Information page form the agreement concerning use of Goldscale and replace prior statements about the same subject.
Severability
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue.
No waiver
A delay or failure to enforce a provision does not waive the right to enforce it later.
Assignment
You may not transfer this agreement or the license granted to you. Elevate may transfer its rights and responsibilities in connection with an organizational change, successor, or lawful transfer of the game, subject to applicable privacy obligations.
Headings
Section headings are included for convenience and do not limit the meaning of a provision.
18. Changes to this agreement
Elevate may revise these terms when Goldscale, applicable law, technology, or operational practices change. The effective date will be updated when a revised agreement is posted. Material changes may also be identified through the game or its information page when appropriate.
Continued use after revised terms take effect constitutes acceptance of those terms. If you disagree with a revision, stop using Goldscale.
